no, to create themes for the 5070 you need Series 40 Theme Studio 1.2 just as for your 6030 mentioned in this thread.
The community at Tehkseven Forums is usually quite helpful when it comes to Nokia S60 and other theming probs. Perhaps someone there encountered the same issue as you; I'd give it a try.

As for the first issue: The list highlight for non-available items can be skinned in Carbide.ui but will only show up in newer phones (from Series 40 6th Edition on).
