If you are not using other people's code with viral licenses such as the GPL and the application is really yours, then you own the copyright and you can make a commercial release unrelated to the open source version
If you *do* use other people's code, then it depends on the licensing requirements of that particular application. Ovi T&C as such just say that it's *you* who has to fulfill those requirements. As an example - if the open source application is GPL, you have to keep the GPL license, and you have to provide the sources to third parties that might request it. Such apps already exist in the Ovi store (see http://stellarium-mobile.org/ ).
Last but least - do not take forum posts as legal advice of any form. If you care about this, ask a lawyer or Ovi with specific details about your project.

The general "guidance" that Nokia has given is that if you use Qt for a legitimate Nokia phone application then you may use the free version of Qt, you are not subject to any license fees for the use of Qt, and you can use it without an explicit written agreement from Nokia. And Qt-based applications created under these terms are acceptable to the Ovi Store.
If you use Qt in other environments you may be subject to other license terms, including payment of license fees and royalties.
But, as stated, this is "free advice", and worth every euro you paid for it.
