Waiver possible?

Hi,

I have been trying to see it in various documents but yet to find some details.
I am developing a application which has some background process and uses APIs which according to this document http://msdn.microsoft.com/en-us/libr...=vs.92%29.aspx suggests that even if some of the APIs compile and run (or you are able to work around some), they might fail the market-place.

My question is: Is it possible to make a waiver (similar to what we had for Symbian Signed) to Microsoft Marketplace?

(Ours is an legitimate app with legitimate use-case for specific legal use and is working for Symbian phones already)

Edit: Am relatively new to Windows Phone environment, so might not be looking at correct place..

The only exceptions are for mobile operators and big partners
