BAK is a Symbian-related concept, thus S40 has nothing to do with it.
I do not see any contradiction in what you have summarized: S40 FAQ says "Coding directly to the operating system is not supported", and S40 is not based on Symbian OS. Where is the problem?
On S40, as things are now, you can develop applications only using Java or Flash Lite, and there is no possible way to get/license any kind of development kit to develop and deploy "native" S40 applications.
So, for S40 native application development today, your only option is for Nokia to subcontract the application from you, and include it in the firmware of an S40 phone model.
