If a project/product is open source, then by definition, source code is available somehow, and the developer/owner of the project/product will most probably say so and how to get the sources.
If no source code is available, then it is not an open source project or product, but closed source.

I'm assuming you meant "If* a project is..." and yes that is obvious but my question was related specific to this project
Nothing suggests that it would be open source. There is "license.txt" in the API download package which puts some restrictions on what you can do with API.
The source code behind the API is not open source, the resultant API library is free to use however (within the terms and conditions defined here: http://www.developer.nokia.com/Develop/Maps/TC.html) - also check the license and readme texts.
The API can be downloaded from the following URL: http://www.developer.nokia.com/info/...3e/JavaME.html
Although the source code behind the API is not available, the download includes a series of example MIDlets which may be freely modified to form the basis of your application.
When the Maps API for Java ME was under development, it was considered an experimental project, and beta versions of the library jar, discussion around the API and feedback from developers was hosted on a projects page.
Now the product has matured to a 1.0 version, and is available for general use, it is hosted under developer.nokia.com - this is standard practice, and indicates a stable release.
The URL you posted is correct, and should be working (I know it doesn't help, but the link worked for me just now). If you are still experiencing difficulty, you could try http://www.developer.nokia.com/Maps/ and then clicking the links from there if it helps.
